WARRANTY
You have just purchased a perishable item! Maximum life can be attained if you follow these simple instructions--proper watering routine and inspections for insect infestation or fungus. With early detection and treatment of plant diseases, problems can usually be corrected. If you have any questions regarding the health of your plant, please contact us so we can be of service.
- The standard warranty is for a 90-day period, excluding bulbs, sod, and annuals, commencing on the date of initial acceptance. All plants shall be alive and in satisfactory growth at the end of the guarantee period. All plants installed by Dues Nursery & Landscaping, LTD after September 1 will be guaranteed until June 1 of the next growing season.
- All materials installed by other than Dues Nursery & Landscaping, LTD have a 50% replacement warranty.
- Any material that is 25% dead or more shall be considered dead and must be replaced at no charge. A tree shall be considered dead when the main leader has died back, or 25% of the crown is dead.
- Warranty may be void if proper care, by owner or owner's maintenance contractor, is not maintained. Plants that were not able to survive transplanting even if done by us also do not fall within the lines of this guarantee.
- The sales associate will inspect the project site at the time of installation and completion for any foreseeable problems and you will be notified if we detect anything that could hinder the plant's growth. However, please notify us immediately if symptoms of plant decline, including wilting, leaf or needle drop, discoloration of leaves or woody stems, insect infestation, etc., are observed. This allows us to quickly determine possible causes and solutions as soon as possible.
- The landscape contractor shall be responsible for a one-time
replacement only.
- Replacements shall be of the same type, size, and quality as original species unless otherwise negotiated.
- The landscape contractor will not be responsible for plant material that has been damaged by vandalism, fire, removal, relocation, wildlife, theft, or other activities beyond the landscape contractor's control. Plant loses due to abnormal weather conditions such as floods, excessive wind damage, drought, severe freezing or abnormal rains will in no way be the responsibility of the landscape contractor.
- Existing plant material transplanted shall not be guaranteed unless otherwise stated by the landscape contractor.
- The following items will be warranted until NOVEMBER 1 of the purchase year upon presentation of warranty ticket and dead plant: Roses, Azaleas, Rhododendrons, Japanese Pieris, Dogwoods, Hemlocks, and all perennials.
- Plant materials, which do not survive and require replacement, will be replaced as they become available and our schedule permits.
- NO CASH REFUND WILL BE GIVEN WITH RESPECT TO WARRANTY CLAIMS.
- No warranty for any labor charges. A labor charge will be charged each time we plant.
- Nursery stock will have a ONE-TIME REPLACEMENT CREDIT on the plant.
- We do not warrant rate of growth on any plant.
- Nursery stock prices are subject to change without notice. We DO NOT REPLACE NURSERY STOCK TREE FOR TREE, PLANT FOR PLANT unless prices are the same.
- ACCOUNTS MUST BE PAID IN FULL BEFORE ANY CREDIT IS ISSUED OR REPLACEMENTS ARE MADE. THIS WILL INCLUDE INTEREST CHARGED.
- There will be no warranty for all discounted items and sales items.
- A $35.00 charge will be made for examining nursery stock at the customer's request. If this item is under warranty by Dues Nursery & Landscaping, LTD, there will be no charge.
- A plant lifetime warranty is available. Inquire at our office.
- We will charge $20.00 on all returned checks.
